IMAGE QUALITY AND PERMITTED USES.

Your images are delivered as high resolution files.  Images may not be used for any commercial purpose without our prior written approval. Use of Images on a business card, resume, Facebook, LinkedIn, or other personal social networking page is permissible and not considered a commercial use. Using Images to create goods or services from the image for resale is a commercial use and is therefore prohibited.

CHANGES TO PRODUCTS AND SERVICES.

If, after the execution of this Agreement, Client requests additional products or services, Photographer and Client may amend the Agreement to reflect the change(s) in Services and related charges (the “Amendment”), which shall become payable immediately upon the execution of the Amendment and/or issuance of an invoice by Photographer. Client understands and agrees that products, services and/or merchandise not included in this Agreement will be sold at the current price, as of the date the order is placed. All prices are subject to change at any time without notice.  Photographer reserves the right to modify the terms and conditions of its products and services, including termination or elimination of products, services, options or benefits, at any time, in its discretion.

INTELLECTUAL PROPERTY.

Except as specifically authorized through the sale of a product or service, or on a written release signed by Photographer and Client, Portraits and information from this Website may not be reproduced in any way. All Images created by Photographer are the property of Photographer. Therefore, except as otherwise specifically provided in this Agreement, you may not copy, download, reproduce, modify, publish, distribute, transmit, transfer or create derivative works, sell, re-sell or exploit the Images without first obtaining written permission from Photographer.  Except as otherwise provided in this Agreement, all Images, are intended solely for personal, noncommercial use by Client and the users of Photographer’s website. You may download, print and/or store selected Images and view, share, create and order portraits and products from us provided you (1) only use these copies of Images for your own personal, non-commercial use, and (2) do not modify or alter the  Images in any way.  Except as otherwise specifically provided in this Agreement, no right, title or interest in any downloaded Images is transferred to you as a result of any such downloading. Photographer reserves complete title and retains full intellectual property rights in all Images that Client or others may download from
Photographer’s website.
